Shawn E. Carey's Sworn Statement
Given December 05, 2010 — Ontario County Jail
Statement from William Dean
Below is the statement given to me by Shawn E. Carey on December 05, 2010 in the Ontario County Jail, wherein he claimed he did the crimes Dean was charged with, and he gave the names of others who he did these with. But would not put too much into a written statement until I could talk to Tantillo to get him a deal, since he was being held for another burglary already.
He agreed to give the statement with just enough information to let Tantillo know it was real. He was willing to testify against the other three who he did the burglaries with, if Tantillo would give him a deal.
Once he made the statement, Dean had him proof read it, and correct any mistakes. He initialed the changes then had it notarized by an Ontario County Sheriff's Deputy, and copies made by an Ontario County Sheriff's Deputy in the Ontario County Jail.
Mr. Carey and myself sent copies to Jeffrey R. Morrow, Esq. who was my attorney. Dean was not informed that Mr. Morrow was also Mr. Carey's attorney.
The Ontario County Sheriff's Deputy Sgt. who made the copies also sent a copy to Tantillo's office at Dean direction, and OCSO Inv. Shaffer. Mr. Carey gave me the original and several copies and he kept a copy.
What Happened to the Statement
During trial this was covered up by everyone. Dean did not know about Mr. Morrow representing Carey either. The sworn notarized statement was sent to the Ontario County DA and Dean's attorney — and ignored.
How Dean Met Carey
Prior to his trial, on/or about December 05, 2010, while being held in the Ontario County Jail, Dean was discussing and complaining to other individuals also being held prior to their own cases, about Tantillo and the false charges he had filed against him again. When another person named Shawn E. Carey, of Canandaigua, NY approached Mr. Dean, telling him that he and others had committed those crimes that Tantillo was charging Mr. Dean with.
He told Mr. Dean during a lengthy conversation that he knew Mr. Dean's brother, Mark Dean, and had taken Samantha Lippa there in May 2010 to get her car fixed, since he was not home they robbed Mark Dean's place and the house was open. And that Ms. Lippa, he, and two other guys robbed several homes in Ontario, Monroe, and Livingston Counties, and went as far as Syracuse, NY to steal from from a drug dealer to support their drug habits.
Mr. Carey knew all the details of some of the items Mr. Dean was accused of stealing and more. Including a Hand Gun to which Mr. Dean had set up a controlled buy with the Rochester Police Department to purchase said Colt 380 gun from Samantha Lippa on March 21, 2010 after they all left the Source Jewelry Store located at 3300 Monroe Ave, Pittsford, NY.
Mr. Dean said he and Mr. Carey went to the law library at the Ontario County Jail and typed up Mr. Carey's statement. Mr. Dean asked Mr. Carey to proof read it and make any changes that are not correct and to initial the changes. Mr. Carey did so and they returned to the jail POD where they were being held and requested a Notary Service from the Jail Deputy.
After the Notary Service was completed, Mr. Dean instructed Mr. Carey to ask the deputy at the desk for copies to be made of the statement. Mr. Dean mailed Mr. Morrow a copy of Mr. Carey's Statement. He kept the original and Mr. Carey had a copy. Copies were also sent to DA Tantillo and Inv. Shaffer by jail staff.
Mr. Dean was finally able to obtain bail on December 11, 2010. On December 13, 2010, Mr. Dean met with Mr. Morrow at the Ontario County Sheriff's Office on 74 Ontario Street, Canandaigua, NY. Mr. Morrow said he never received the statement in the mail when Dean questioned him about it. Mr. Dean left the original copy with Mr. Morrow — not knowing that Mr. Morrow was also representing Mr. Carey on burglary 2nd charges pending in Ontario County. Neither Mr. Carey nor Mr. Morrow ever mentioned such to Mr. Dean.
