NY STATE POLICE AND ONTARIO COUNTY DA ARE AGAIN TAMPERING WITH PHYSICAL EVIDENCE AND MORE!

Canandaigua, NY — William Dean served 16 of his 21-year sentence in Attica and Marcy Correctional Facility. He was found guilty by jury trial on March 03, 2011 by the use of false and fabricated evidence by public officials. He has the evidence he did not commit the crimes but everyone ignored him.

What They Did

Mr. Dean said they fabricated and falsified witness statements and evidence in his case to obtain an unlawful indictment and conviction, in County of Ontario, Canandaigua, NY. NYSP unlawfully searched his property in the Monroe County Jail on July 22, 2010 and two NYSP Investigators tampered with his property, took photographs, and removed his said property without a search warrant.

Dean said, they found in a NYSP report from Inv. Dake, that he unlawfully seized property of mine and took it back to NYSP Troop E Barracks on July 22, 2010, in Farmington, NY at 1596 Rochester Road, County of Ontario, where NYSP Inv. Miklos S. Szoczei II instructed NYSP Inv. Aaron B. Dake to hold the pictures and property he took unlawfully until August 06, 2010, so that NYSP Inv. Szoczei II could obtain a search warrant for the property they switched and removed without a search warrant (though it belonged to Dean and was not stolen property).

On August 02, 2010 NYSP Inv. Szoczei II approached Ontario County Court then Judge, Hon. William Kocher with an application for a search warrant to search the property of William Dean, located at the Monroe County Jail, 130 South Plymouth Ave, Rochester, NY 14614, County of Monroe.  What NYSP Inv. Szoczei II did not tell Judge Hon. Kocher was that NYSP Inv. Aaron B. Dake had already searched the property in the Monroe County Jail on July 22, 2010, took photographs and removed Dean's T-shirt, returning with it to the NYSP Troop E Barracks. Nor did Szoczei II inform Hon. Kocher that they switched the property at the Barracks or the jail — the shirt of Dean's somehow became Blue, not red or orange as reported in Monroe County Sheriff's Office police reports.

On May 26, 2010, NYSP Inv. Szoczei II and Ontario County Sheriff's Office Investigator Gregory J. Shaffer went to the Monroe County Jail to interview a suspect arrested with Mr. Dean.  Inv. Szoczei made a falsified report stating that Leighanne Attridge-Kuchinick said she was at the Walmart in Macedon, NY on April 27, 2010 with William Dean, and did use a stolen credit card to purchase certain items, including the alleged BLUE T-shirt.

Mr. Dean was arrested on a trumped-up charges from then Ontario County DA Michael R. Tantillo — a fabricated arrest warrant from the Town of East Bloomfield Town Court on a fabricated Aggravated Harassment 2nd charge, alleging it was illegal to send a single text message using profanity.  The NYS Statute of Penal Law 240.30(1)(a) had been ruled by the highest court as unconstitutional for years prior to the false charge brought again Mr. Dean. Monroe County Court Judge Hon. Daniel Doyle recognized their mistakes and dismissed all charges against Mr. Dean in Monroe County.

Ontario County Deputy Rebecca Edington, working under specific direction of Tantillo, brought all property seized from Dean's car back to Ontario County directly from the search warrant's execution — without returning said property to the Pittsford Town Court Judge as required by statute to protect a proper chain of custody.  Ontario County Sheriff's Office Inv. Gregory J. Shaffer, directed by Tantillo, alleged that Mary Jane Pellicano identified three DVD movies found in Dean's car as stolen property — yet Tantillo used this false evidence to obtain an unlawful indictment and conviction, knowing it was never identified as any stolen property from anyone.

Prior to his trial, on/or about December 05, 2010, while being held in the Ontario County Jail, another person named Shawn E. Carey of Canandaigua, NY approached Mr. Dean, telling him that he and others had committed those crimes that Tantillo was charging Mr. Dean with.  Mr. Carey spelled out in very precise details as to what they stooled and where it went.  That he was willing to put some of it into writing and would give all the details if he could get a deal for the burglary he was currently being charged with.

On February 03, 2011, just days prior to Mr. Dean's trial, Ontario County and NYSP Officers claimed that Mr. Dean abducted a woman (Ms. Attridge-Kuchinick, by then his wife) at gunpoint and put out an all-points bulletin saying he was armed and dangerous.  Mr. Dean and his wife were arrested while eating lunch at McDonald's on Lake Ave, Rochester, NY.  After an extensive search, no weapons were found.  NYSP Inv. Szoczei arrived on scene, opened the police car door and said to Mr. Dean: "gotcha now a**hole."

Mr. Dean's bail was rescinded on February 04, 2011 in front of Ontario County Court Judge Hon. Craig J. Doran and he was remanded to the Ontario County Jail without bail.  He was tried and falsely convicted, leading to a 21-year sentence with 5 years of post-release supervision. Dean had been initially offered 5 years in prison by the DA, which he rejected, stating: "I can't be found guilty for something I did not do and sure as hell will not plead to something I did not do either.  That would be lying under oath and I will not do that"

Dean's then attorney, Jeffrey R. Morrow (is no longer practicing law in NY), nor did did he call or investigate any of Dean's alibi witnesses, saying on the first day of trial when asked where they were: "they're friends and family and are unreliable."  Nor did Mr. Morrow tell Dean that he was also representing the real suspects — Shawn E. Carey of Canandaigua, NY, along with three others who did the crimes, including Samantha Lippa.

The Facts of Misconduct

Unlawful Search

NYSP Inv. Aaron B. Dake searched Dean's property at Monroe County Jail on July 22, 2010 — without a warrant. Dean's shirt removed and switched at the NYSP Barracks or the MC jail, changing from orange/red to blue.

Fabricated Warrant

On August 02, 2010, Inv. Szoczei II applied for a search warrant based on fabricated information, concealing the prior unlawful search from Judge Hon. William Kocher.

Defense Attorney Conflict

Attorney Jeffrey R. Morrow (no longer practicing in NY) was simultaneously representing the real suspect, Shawn E. Carey, for related burglaries — and called Dean's alibi witnesses 'unreliable' without investigating them.

Carey's Sworn Statement

Shawn E. Carey provided a sworn notarized statement identifying who actually committed the crimes — sent to DA Tantillo and Morrow from the Ontario County Jail. It was ignored and covered up.
